What Is Workers Compensation?

What Is Workers Compensation | Workers' Comp Benefits

So what is workers compensation? Workers compensation is a term used to describe the benefits that you could potentially get from your employer or their workmen's compensation insurance company when you are hurt while working or on the job. Workers compensation insurance is paid on a regular basis by your employer to their insurance company in case an employee is hurt on the job, but that does not mean any of your benefits will be paid.

If you have been injured or hurt at work and want to receive workers compensation benefits, it is best to call an experienced attorney as soon as possible to help you fully understand and enforce your rights and answer your questions about “what is workers compensation”. The longer you delay, the more difficult it will be to get the workers compensation benefits to which you are entitled under Missouri law but must fight to win. You do not get them automatically.

St. Louis attorney Tom Hyatt of St. Louis Workers' Compensation Center can help and will fight tirelessly for you. We offer a FREE no obligation consultation to review your case and answer your workers comp questions. Injured and not able to come to us? Not a problem, we can come to you if you are within 100 miles of St. Louis.

What is Workers Compensation & What are the Benefits It Provides?

So what is workers compensation and what are the types of workmen's compensation benefits to which you may be entitled. Under Missouri state law, individuals may be entitled to any of three main types of workers compensation benefits. These include:

  • Compensation for required medical treatment or surgery resulting from an injury
  • Weekly temporary total disability pay to compensate for lost wages when the employee must stay off work on doctors' orders
  • Permanent disability lump sum benefits

All of these benefits are potentially covered and paid for by your employer's workmen's compensation insurance. However, there is nothing automatic about getting any of these benefits. You must apply for and, in many cases, fight for your benefits Missouri law potentially entitles you to.

Often employers refuse to pay any benefits and cut them off early, and send you to doctors who will under treat you and ignore most of your problems from your injuries. They will refuse to give you all medical tests to find out what is really wrong with you, release you from treatment way too early, and refuse to keep you off work long enough for you to properly recover from your injuries. Then when they finally release you from treatment they will rate you at little or no permanent disability in order to reduce or eliminate the money benefits the insurance company might owe you and have to pay you for your permanent disability if they had only fairly evaluated you in the first place.

The only way to fight back to is hire an attorney to file and prove your claim for these denied and underpaid benefits. Tom Hyatt at St. Louis Workers' Compensation Center can do that for you and the sooner you act, the better your chances of getting your benefits since certain strict time deadlines and restrictions will always apply.
